TERMS AND CONDITIONS - Landscape MaintenanceAcceptance of proposal - This proposal shall remain valid for 30 days from the date submitted to Customer. And will become a binding Agreement/Contract once signed by Customer.
Basic Maintenance - Reef Tropical is not responsible for breakage of buried and unmarked objects, including pipes and wires, as a result of performing normal landscape maintenance. On site adjustments may be made as necessary. This agreement contains the complete scope of work to be performed by Reef Tropical. Changes or additional work shall be done in writing and may be subject to additional costs. Reef Tropical shall furnish all tools, equipment and labor to maintain landscape described herein. The Customer will grant the Contractor access to the property during regular business hours Monday through Friday and from the times 6:30am to 5:00pm local time and additional mutually agreed upon times. Customer will pay Contractor for additional maintenance or repair that may become required for the lawn to sustain an acceptable appearance. The Contractor shall bill the Customer for the cost of work that is above and beyond what is considered reasonable and customary for normal maintenance of the lawn.
Customer Obligations - The Customer need not be present during service calls and hereby grants permission to the Contractor and shall facilitate entry to access the property on scheduled or otherwise agreed service days and times during regular business hours Monday through Friday and from the times 7:00am to 5:00pm local time. The Customer shall be responsible for the removal of any objects e.g. toys, furniture, pet waste, rubbish etc. that will hinder the Contractor in performing the services. The Customer shall keep all pets secured inside a building or fenced area and shall keep people away from the Contractor's area of work for the safety of all parties concerned whilst the Contractor is performing services. The Customer shall notify the Contractor in writing of any plants that are particularly rare or are a collector's item and their approximate replacement costs. The Contractor reserves the right not to perform any services in close proximity to such plants.The Customer shall be responsible for the day-to-day care of the lawn as recommended by the Contractor and which are not part of the services outlined in the Contract.
Additional work. Any additional services requested by Customer will be billed at the per visit cost according to the Contract and added to monthly invoice. Any additional work requested by the Customer or proposed by the Contractor which is not specified in the Contract shall be quoted for separately and when completed invoiced immediately.Subcontractors - Contractor may engage subcontractors to perform work at its discretion, provided that Contractor shall fully pay any subcontractors and in all instances remain responsible for the proper completion of this Contract.
Irrigation Checks - Irrigation wet checks will be performed only if included in signed Contract. The service is offered to maintain the proper hydration of the landscape and is NOT meant to be a water management tool. Responsibility for the irrigation system lies in the hands of the owner - mysterious changes of settings, damage to the system or over usage is a shared responsibility with the multiple stewards of the property. Reef Tropical is not financially responsible for the system but as an integrity driven organization, will take responsibility when at fault. We strive to do our best with each customer's best interest in mind combined with the overall landscape health.
Arrival Policy: Properties are all on a set schedule and performed within a route. Most residential landscapes are promised to be serviced each week or every other week. This varies with commercial properties. The Customer Service Department and the crews will change the schedule to accommodate your upcoming arrivals – within reasonable notice. Any additional service outside of the regularly scheduled maintenance is an extra cleaning charge, as determined by Reef Tropical staff. We do our best, at our discretion and as a courtesy, to move route schedule prior to arrival. Unfortunately, this does not work in all cases.
Cancellation Policy: This agreement shall automatically renew, unless either party provides notice to the other of its intent to terminate this agreement not less than thirty (30) days before the end of the current month. Customer reserves the right to cancel service at any time, with a 30-day notice. Any payments made in advance, i.e. annual payments, would be refunded accordingly.
PAYMENT. We prefer to be paid by check or money order. We require a credit card on file prior to start of work. Payment schedule should be reflected on proposal. If not, payment is due in full upon signing proposal. In the event any balance due Contractor is not paid within 30 days of Contractor’s invoice, then the Customer shall be in default.
Delinquent Accounts: Reef Tropical reserves the right to initiate collection procedures if the customer’s account is 90-day past due. Reef Tropical will attempt to collect past due by first calling the customer and then sending an e-mail to the customer. Customer shall be responsible to pay interest at the rate of 1½% per month (18% per annum) on any unpaid amount and to pay all costs and expenses, including but not limited to reasonable attorney’s fees and costs, incurred by Contractor in collecting any outstanding amount due under this Agreement, or enforcing its rights hereunder, with or without suit. Proper venue for any litigation stemming from this Agreement will be a court of competent jurisdiction in Miami-Dade County, Florida. Reef Tropical will set the payment schedule and submit to client for approval. Without adherence to the payment schedule, Reef Tropical reserves the right to stop work. Non or late payment will affect the completion time and schedule. The customer will continue to receive phone calls and emails from Finance Department. If the account continues to be delinquent for 120 days, the customer will then receive a final notification from our Finance Department stating that the credit card or checking account on file will be charged the balance due with incurred late fee accrued and a cancellation of service will ensue. This is the last option and we have hardly ever had to do this.
Disclaimer: Reef Tropical will not be responsible for any damage to property due to acts of nature, fire, vandalism, misuse or abuse. Reef Tropical is not responsible for the performance of any landscape material we do not sell. Reef Tropical recommends other annual services (e.g. heavy pruning, pest and fertilization, tree work) above normal maintenance. Reef Tropical is not responsible for any damages or deterioration caused by failure of Customer to perform other services recommended by Reef Tropical or by failure of Customer to properly maintain landscape between visits. If you have any complaints or concerns regarding frequency or completeness of service, you must call Reef Tropical at 305-367-2005 within 24 hours after the service occurs or was scheduled to have occurred.
Jurisdiction Venue: This agreement is enforceable in Miami-Dade County and Monroe County, as applicable.
